Terms and conditions

1. Seller and scope

The operator of this online shop under the name Magic Bahn and your contracting party for orders is Swaravo LLC, 30 N Gould St Ste N, Sheridan, WY 82801, USA. Email: support@magicbahn.com. These terms apply to orders through magicbahn.com and use of the shop functions. Mandatory statutory consumer rights remain unaffected. Full company details are available in our legal notice.

2. Website use and customer account

Please provide accurate contact details and a complete delivery address when ordering. If you use a customer account, protect your login details and inform us of suspected unauthorised access. You must not use the website to infringe others' rights or compromise its security. Measures against misuse do not affect rights under contracts already concluded.

3. Products and conclusion of the contract

Product listings in the shop are not binding contractual offers. You can add items to your cart and check and correct your information before placing the order. By using the final order button at checkout, you submit a binding order.

We acknowledge receipt electronically. An automatic acknowledgement of receipt does not yet constitute acceptance of the offer. The contract is concluded when we expressly accept your order or dispatch the goods. If we cannot accept an order or supply ordered goods, we will inform you and refund payments already received.

Essential characteristics, contents and relevant information are set out in the product description. Pay particular attention to dimensions, connection type, age recommendations and safety information. Mentioning another track system does not promise that all products from both sellers are mutually compatible. The contract languages are German and English.

4. Prices, shipping costs and payment

Product prices, taxes charged, shipping costs and the total applicable to your order are displayed at checkout before you place the order. Information on shipping costs, delivery times and our coverage of import charges is available in the shipping policy.

Prices, discounts, shipping costs and promotional conditions may change with the season and offer. The conditions displayed before completion of your specific order apply. A current promotion does not create an entitlement to the same discounts or free shipping permanently. Later changes do not alter amounts already agreed for an order.

The available payment methods are those offered at checkout for your specific order. Third-party payment services may have supplementary terms; your statutory rights against us remain unaffected. Payment timing depends on the method chosen and the conditions shown before you complete your order.

5. Delivery

Delivery destinations, shipping costs, processing time and estimated transit time are described in our shipping policy. Processing and transit are separate stages. We will inform you of foreseeable significant delays. Statutory claims for non-delivery or delayed delivery remain in place.

6. Withdrawal and defects

Consumers have a statutory fourteen-day right of withdrawal. Details, costs, the return address, refund deadlines and the model form are available in our withdrawal and returns policy. Muse Trading Limited in Hong Kong acts solely as the returns reception for Magic Bahn; Swaravo LLC remains your seller and contracting party.

Longer return rights already agreed for earlier orders, particularly a promised 30-day return right, continue under the conditions agreed at purchase. These terms do not retrospectively shorten existing commitments.

Statutory rights relating to defective goods apply; for new goods, the statutory limitation period for defect claims is generally two years from delivery. A request for early notification or photographs does not shorten these rights. Additional voluntary guarantees apply only if expressly stated for the product concerned; mandatory statutory rights remain unaffected.

7. Content and trademark rights

Texts, product images, graphics and other content may be used only within applicable laws and the rights of their respective rights holders. Use beyond what the law permits requires the relevant consent. Magic Bahn operates independently of other toy brands. Where used, third-party brand names describe the relevant product and its stated compatibility; this does not imply authorisation or partnership.

8. Privacy

Information on personal data processing, cookies, services used and your rights is available in our privacy policy.

9. Liability

We are liable in accordance with applicable statutory provisions. These terms do not exclude or limit liability where this would be unlawful. In particular, mandatory consumer rights, claims for death or personal injury, and statutory product liability remain unaffected.

10. Changes and website functions

The terms applicable when an order is placed apply to that order. Later changes do not retrospectively affect contracts already concluded to your detriment. Changes to individual website functions do not affect existing contractual claims or mandatory statutory rights.

11. Applicable law and disputes

Applicable law governs. Where a choice of law is validly agreed, it does not deprive consumers of the protection of mandatory provisions in their country of habitual residence.
