Scope and Provider
(1) The following Terms and Conditions apply to all orders placed through our online store at magicbahn.com.

(3) For the purposes of these Terms and Conditions, a consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession (§ 13 of the German Civil Code, BGB). An entrepreneur is any natural or legal person, or a partnership with legal capacity, who, in entering into a legal transaction, acts in the course of their trade, business, or profession (§ 14 BGB).
§ 2 Formation of the Contract
(1) The display of products in the online store does not constitute a legally binding offer, but rather a non-binding invitation to place an order.
(2) By clicking the “Buy now” or “Complete order” button, you place a binding order for the items in your cart.
(3) We will confirm receipt of your order immediately after you submit it by sending an automated confirmation email. This confirmation does not yet constitute acceptance of your order. The purchase contract is formed only once we accept your order through an express declaration of acceptance or by shipping the goods.
(4) We store the text of the contract and send it to you by email along with these Terms and Conditions. You can also review the Terms and Conditions at any time at magicbahn.com/policies/terms-of-service.
(5) The contract languages are German and English.
§ 3 Prices and Shipping Costs
(1) All prices shown are final prices in euros (€). For deliveries to the European Union, the applicable import VAT is collected at checkout under the IOSS procedure and is already included in the price shown; no further import charges apply on delivery.
(2) We ship from our international logistics center. The import VAT for deliveries to the EU is collected at checkout under the IOSS procedure, so no further charges apply on delivery within the EU. For deliveries to non-EU countries (such as Switzerland), local import charges may apply in individual cases and are the buyer’s responsibility.
(3) Shipping costs are shown separately and are set out in our Shipping Policy.
§ 4 Delivery
(1) We ship to Germany and to other countries we specify. Please see our Shipping Policy for delivery times and available shipping destinations.
(2) If we are unable to deliver an ordered product for reasons beyond our control (for example, because it is no longer available), we will let you know without delay. In that case, any payment you have already made will be refunded promptly.
§ 5 Payment
(1) Our store offers a range of payment methods, which are shown during checkout (for example, credit card, PayPal, Apple Pay, and Google Pay).
(2) Payment is due at the time you place your order. In the event of late payment, we reserve the right to charge statutory default interest.
§ 6 Retention of Title
The goods remain our property until the purchase price has been paid in full.
§ 7 Right of Withdrawal for Consumers
Consumers have a right of withdrawal in accordance with our separate cancellation policy. You can find the full withdrawal instructions and the model withdrawal form at magicbahn.com/policies/refund-policy.
§ 8 Warranty and Guarantee
(1) The statutory rights regarding defects apply. If goods are defective, you may first request that we cure the defect (by repair or replacement). If our attempt to cure fails, you may, at your discretion, request a price reduction or cancel the contract.
(2) The limitation period for claims based on defects is two years from delivery of the goods.
(3) Any guarantee beyond this is granted only where we have expressly stated it for the relevant item in the order confirmation.
§ 9 Liability
(1) We are liable without limitation for damages arising from injury to life, body, or health; for damages caused by an intentional or grossly negligent breach of duty by us or our agents; and for damages within the scope of the German Product Liability Act.
(2) In the event of a slightly negligent breach of an essential contractual obligation (a cardinal obligation), our liability is limited to the foreseeable damage typical of this type of contract. Any liability beyond this is excluded.

§ 11 Online Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR), which you can find at https://ec.europa.eu/consumers/odr. We are neither obligated nor willing to take part in dispute resolution proceedings before a consumer arbitration board.
§ 12 Final Provisions
(1) Contracts between us and our customers are governed by the law of the State of Wyoming, USA, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers residing in the European Union, however, the mandatory consumer protection provisions of the law of their habitual residence remain unaffected (Art. 6(2) Rome I Regulation).
(2) If any provision of these Terms and Conditions is or becomes invalid, the validity of the remaining provisions will not be affected.
§ 13 Copyright and Trademark Rights
(1) All content on this website (text, images, graphics, designs, and logos) is the property of Swaravo LLC (brand name “Magic Bahn”) or is used with the permission of the respective rights holders. Any reproduction, modification, distribution, or commercial use without our express written consent is prohibited.
(2) Any third-party brand names mentioned (for example, BRIO, LEGO, IKEA, Hape, and Eichhorn) are the property of their respective owners and are used solely to describe product compatibility. There is no business relationship, sponsorship, or authorization by these brand owners.
